The levy and imposition of a one percent (1%) citywide retailers’ sales tax is hereby authorized, with such collection to commence on October 1, 1988.

The levy and imposition of a one percent (1%) citywide retailers’ sales tax is hereby authorized with revenue received therefrom to be used to finance the costs of general improvements to the LaCygne Community Park, including a swimming pool project and swimming pool operation and maintenance costs, with collection of such sales tax to commence on October 1, 2009, and to terminate after 25 years (September 30, 2034).

(a)   In accordance with the provisions of K.S.A. 12-1,118, there is hereby established a capital improvements fund, which shall be used by the City to finance, in whole or in part, any public improvement need set forth in the city’s capital improvement plan.

(b)   It is the policy objective of the Governing Body that such fund shall be used primarily to provide a financing mechanism for the repair, restoration and rehabilitation of existing public facilities. Further, it is the intent of the Governing Body to utilize current revenues to be credited to the fund, to the maximum extent possible to meet the city’s present and future public infrastructure needs and to avoid the costs of unnecessary indebtedness.

(c)   Moneys in such fund may be used to pay the cost of engineering and other advanced public improvement plans and studies, with the fund periodically reimbursed from bond proceeds, special assessments or state or federal aid that may be available for the completed project. No expenditures for such purposes shall be made except on a finding of the Governing Body of its probable intent to proceed with the improvement following such engineering or advanced study.

(d)   The city clerk shall submit to the Governing Body a plan of operation for the implementation of this ordinance. Such plan shall provide that the annual, revised and adopted capital improvements plan of the city identify those improvements to be Financed from the fund during the following year.

(e)   Beginning in 1994, the city clerk shall annually submit, at the same time and as a part of the annual operating budget, such proposed revenue allocations and budget transfers as may be necessary (a) to finance those improvements scheduled for completion next year, the cost of which is to be credited to the fund, as provided by the capital improvements plan, and (b) to set aside moneys to be annually reserved for future improvements, as provided in the capital improvements plan.

(f)    Moneys in the capital improvements fund shall be invested in accordance with the provisions of K.S.A. 10-131 and amendments thereto, with interest thereon credited to such fund.

(a)   In accordance with the provisions of K.S.A. 12-1,117 there is hereby established an equipment reserve fund, which shall be used by the City to finance, in whole or in part, the acquisition of equipment including machinery, vehicles, and any other equipment or personal property including, but not limited to, computer hardware and software, which the city is authorized to purchase for municipal purposes.

(b)   It is the policy objective of the Governing Body that such fund shall be used primarily to provide a financing mechanism for the repair, replacement, or acquisition of municipal equipment. Further, it is the intent of the Governing Body to utilize current revenues to be credited to the fund, to the maximum extent possible to meet the City’s present and future equipment needs and to avoid the costs of unnecessary indebtedness.

1-705.         Main trafficway designations for bond financing purposes.

The following are designated as main trafficways of the city pursuant to K.S.A. 12-685 et seq. for purposes of bond financing certain improvements: Hillside Drive, Grand A venue, Lincoln A venue, Swan Street, Chestnut Street, Market Street, Vine Street, Linn Street, Industrial Road, 1st Street, Broadway, 4th Street and 8th Street

The following are designated as trafficway connections pursuant to K.S.A. 12-685 et seq. for purposes of bond financing certain improvements: 2nd Street (from Linn Street to Market street), 2nd Street (from Lincoln Avenue to Grand Avenue), 3rd Street (from Linn Street to Vine Street), 3rd Street (from Chestnut Street to Swan Street), 5th Street (from Market Street to Grand Avenue), 6th Street (from Linn Street to Hillside Drive), Railroad Avenue (from Broadway to Chestnut Street), Commercial Street (from Broadway to Chestnut Street), Grand Avenue (from Broadway to 8th Street), Locust Street (from 1st Street to 8th Street), Walnut Street (from Broadway to 8th Street), Sycamore Street (from 1st Street to Broadway) and Elm Street (from 1st Street to 4th Street).
