(a)   There shall be no parking in the following blocks within the City of La Cygne:

(1)   On the north side or south side of Market Street between 5th and 6th Street;

(2)   On 6th Street north to Walnut Street;

(3)   On both the east and west sides of 1st Street north for a distance of 200 feet from the intersection with Market Street.

(b)   The streets or portions thereof set forth in this section are designated as no parking zones.  No parking zones shall include the following streets or portions thereof:

(c)   No person shall allow any vehicle to remain standing for more than two continuous hours along the following described streets of the City of La Cygne: On the north side and south side of Market Street from a point beginning at Railroad Avenue east to 5th Street.

(d)   The Chief of Police shall undertake to mark the areas concerned in such a way as is calculated to reasonably apprise persons parking in such areas of the restrictions imposed thereon by this section.

(e)   Anyone parking in an area described herein in excess of the posted time limit shall be guilty of a misdemeanor, and upon conviction thereof shall pay a fine as set in the city’s fee resolution.

(f)    Any person intentionally interfering with enforcement of these regulations by thwarting or attempting thwart the Chief of Police or his designated officer’s efforts to determine how long a vehicle has been parked in a particular time zone shall be guilty of a misdemeanor, and upon conviction or plea of guilty shall be fined in an amount as set in the city’s fee resolution. Any person aiding, abetting, or assisting in such interference shall be guilty of the same offense.

(a)   Following is a list of zones on public streets where parking is prohibited at specific times on school days in the vicinity of school buildings in order to facilitate traffic management related to school activities:

Whenever any motor vehicle is found parked, standing, or stopped in violation of this article or any ordinances, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a traffic citation.

Fines for violations of parking regulations as stated in this article are to be set by the city’s fine schedule.

(a)   All vehicular traffic traveling upon Walnut Street between 7th Street and 8th Street shall travel only in a westerly direction. The City of La Cygne shall cause to be placed upon Walnut Street between 7th Street and 8th Street one-way traffic signs indicating a one-way flow of vehicular traffic in a westerly direction only.

(b)   It shall be unlawful for any person to operate a motor vehicle, as that term is described in chapter 8 of the Kansas Statutes Annotated, in any fashion other than so authorized by the above and foregoing section, and any person who shall operate their motor vehicle in a fashion prohibited by this section shall be deemed to be guilty of a misdemeanor and shall be fined a sum as set in the city’s fee resolution.

(a)   No person driving any vehicle shall unnecessarily exhibit speed or acceleration, make excessively rapid acceleration from a stopped or moving position or unnecessarily rev the engine of a vehicle while the vehicle is stopped.

(b)   “Exhibition of speed or acceleration” is defined to include, but is not limited to, those acts which cause or create unnecessary rapid acceleration, unnecessary tire squeal, skid, smoke, or slide upon acceleration or stopping including the casting of tread, gravel, dirt, or other road surface materials from the tires; acts that simulate a temporary race; acts that cause the vehicle to unnecessarily turn abruptly, sway or lose traction with the road surface.

(c)   Any person violating the provisions of this section shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in a sum as set in the city’s fee resolution.

(a)   It shall be unlawful for the driver of any motor vehicle, motor cycle, or motor driven cycle to make a U-turn on Market Street, between Industrial Street and First Street, and on Broadway Street between Market Street and Grand Street of La Cygne, Kansas, so as to proceed in the opposite direction, except at intersections only.

(b)   It shall be unlawful for the driver of any motor vehicle, motor cycle, or motor driven cycle to turn such vehicle so as to cross over the center of the street and park or stop such vehicle in a diagonal or parallel parking place on Market Street, between Industrial Street and First Street, and on Broadway Street between Market Street and Grand Street of La Cygne, Kansas.

(c)   Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in the sum as set in the city’s fee resolution.

In the interest of public safety and having full regard for the traffic conditions upon said highway, under the conditions found to exist as the result of the traffic investigation by the Kansas Department of Transportation on or about January 11, 1995. The City hereby declares the reasonable speed of the following section of K-152 shall not exceed the speed limits as follows for their respective distances:

(a)   35 miles per hour for the first section of 0.374 mile, more or less, beginning at the intersection of the centerline of K-152 and the SW corner of Section 33, T-19-S, R-24-E, and continuing thence east.

(b)   30 miles per hour for the second section of 0.470 mile, more or less, beginning 0.374 mile east of the centerline of K-152 and the SW corner of Section 33, T-19-S, R-24-E and continuing thence east.

(c)   35 miles per hour for the third section 0.160 mile, more or less, beginning 0.160 mile west of the SW corner of Section 34, T-19-S, R-24-E, continuing thence east.

(d)   A total distance of 1.004 miles, more or less, to be zoned.

The following streets and parts of the streets are declared to be within school zones for the purpose of regulating traffic.

La Cygne Elementary School

Said school zone is located at a point starting at the west side of 6th Street and Market Street (KS Highway 152) east thru to the middle of the intersection (a straight line running north and south at such intersection) at 9th Street and Market Street in the City of La Cygne, Kansas.

The 20 mile per hour school zone speed limit shall be in effect in the school zones in the City of La Cygne during the hours in which students are normally in route to or from school which is the following times:

(a)   7:00 A.M. – 8:00 A.M.  Monday, Tuesday, Thursday, Friday

(b)   8:00 A.M. – 9:00 A.M.  Wednesday

(c)   3:00 P.M. – 4:00 P.M.  Monday thru Friday

(a)   No person operating or occupying a motor vehicle on a street, highway, alley, parking lot, or driveway shall operate or permit the operation of any sound amplification system from within the vehicle so that the sound is plainly audible at a distance of fifty (50) feet or more from the vehicle.

(b)   Sound Amplification System means any radio, tape player, compact disc player, loud speaker, or other electronic device used for the amplification of sound.

(c)   Plainly Audible means any sound produced by a sound amplification system from within the vehicle, which clearly can be heard at a distance of fifty (50) feet or more. Measurement standards shall be by the auditory senses, based upon direct line of sight. Words or phrases need not be discernible and bass reverberations are included. The motor vehicle may be stopped, standing, parked, or moving on a street, highway, alley parking lot, or driveway.

(d)   It is an affirmative defense to charge under this section that the operator was not otherwise prohibited by law from operating the sound amplification system, and that any of the following apply:

(1)   The system was being operated to request medical or vehicular assistance or to warn of a hazardous road condition;

(2)   The vehicle was an emergency or public safety vehicle;

(3)   The vehicle was owned and operated by the City of La Cygne or a gas, electric, communications, or refuse company;

(4)   The system was used for the purpose of giving instructions, directions, talks, addresses, lectures, or transmitting music to any persons or assemblages of persons in compliance with ordinance of the City of La Cygne;

(5)   The vehicle was used in authorized public activities, such as parades, fireworks, sport events, musical productions, and other activities which have the approval of the department of the city authorized to grant such approval.

(e)   Penalty. Any person, individual, partnership, corporation, or association who violates any of the provisions of this article is guilty of an ordinance violation, and upon conviction, shall be punished by a fine as set in the city’s fee resolution or by imprisonment of not more than six months, or by both such fine and imprisonment. Each day any violation hereof is found to exist or continues to exist shall be a separate offense and punishable as such hereunder.

(a)   It shall be unlawful for the driver of any vehicle to use or operate or cause to be used or operated within the city any mechanical exhaust device designed to aid in the stopping or braking of a vehicle, in a manner so as to create excessive, loud, or unusual explosive noise from a vehicle.  This prohibition shall include, but not be limited to, the procedure commonly known as jake-braking.

(b)   Penalty. Any person, individual, partnership, corporation, or association, who violates any of the provisions of this article is guilty of an ordinance violation, and upon conviction, shall be punished by a fine as set in the city’s fee resolution or by imprisonment of not more than six months, or by both such fine and imprisonment.  Each day any violation hereof is found to exist or continues to exist shall be a separate offense and punishable as such hereunder.
