There is hereby incorporated by reference, as if set out fully herein, for the purpose of promoting the public health, safety, prosperity and general welfare within the corporate limits of the City of La Cygne, Kansas, that certain zoning regulations entitled “Zoning Regulations of the City of La Cygne, Kansas” as prepared by the City and adopted in book form on November 2, 2005.  No fewer than three (3) copies of the Zoning Regulations dated October 2005, marked “Official Copy as Incorporated by the Code of the City of La Cygne, Kansas”, and to which there shall be a published copy of this section attached, shall be filed with the City Clerk to be open for inspection and available to the public at all reasonable business hours.

Said zoning regulations have subsequently been amended as indicated in the history of this section.

There are further herein incorporated by reference and adopted an Official Zoning Map delineating the boundaries of zoning districts and the classification of such districts which map shall be marked “Official copy of zoning district map incorporated into zoning regulations by adoption of Ordinance No. 1312 and 1334” and filed with the City Clerk to be open for inspection and available to the public at all reasonable business hours.

Said zoning regulations have subsequently been amended by Ordinance Nos. 1330, 1348, 1351, 1352, 1356, 1364, 1365, 1375, 1386, 1391, 1392, 1393, 1395, 1405, 1419, 1428, 1449, 1467, 1477, 1485, 1490 and 1501.

Pursuant to K.S.A. 12-761, the violation of any provision of the Zoning Regulations shall be deemed a misdemeanor and any person, firm, association, partnership or corporation convicted thereof shall be punished by a fine not to exceed $500 or by imprisonment for not more than six months for each offense, or by both such fine and imprisonment, and that each day’s violation shall constitute a separate offense. The Governing Body shall further have the authority to maintain suits or actions in any court of competent jurisdiction for the purpose of enforcing any provisions of these regulations and to abate nuisances maintained in violation thereof, and, in addition to other remedies, institute injunction, mandamus, or other appropriate action or proceeding to prevent unlawful construction, erection, reconstruction, alteration, conversion, maintenance, or use, or to correct or abate such violation, or to prevent the occupancy of any building, structure or land.

(a)   The following fees are hereby established for the purpose of wholly or partially defraying the costs for proceedings under the City Zoning Regulations in changes of zoning district classifications and for conditional use applications.

(1)   Application for Rezoning                                     $100.00

(2)   Application for Conditional Use Permit                $ 75.00

(3)   Application for Planned Unit Development           $ 200.00

(b)   If notifications have been given for an amendment to a zoning district and/or conditional use and the applicant requests a deferral of the hearing, the applicant will be charged the actual cost of re-notification.

(c)   The following fees are hereby established for the purpose of wholly or partially defraying the costs of proceedings before the Board of Zoning Appeals for appeals from the decision of the Zoning Administrator, variances, and exceptions.

(1)   Appeal                $70.00

(2)   Variance             $70.00

(3)   Exception            $70.00

(d)   If notifications have been given for an appeal, variance, or exception and the applicant requests a deferral of the hearing, the applicant will be charged the actual cost of re-notification.

(e)   The following fees are hereby established for the purpose of wholly or partially defraying the costs of administration and enforcement under the Zoning Regulations for various permits and/or certificates:

(l)    Zoning Permit                             $25.00

(2)   Zoning Permit, accessory uses      $10.00

(3)   Zoning Permit, signs                    $10.00

(f)    No part of the fees shall be refunded after payment is made in advance of filing an application. except when a zoning permit is not approved by the Zoning Administrator.
